Terms And Conditions

Making A Purchase
Please read our Terms & Conditions. They apply to use of the website and by placing an order you agree to be bound by them.

When you place an order request on our website, you will receive an email acknowledgement which will confirm all relevant details. This acknowledgement is not acceptance of your order and does not mean that a contract exists between us.

We will send you an confirmation email & dispatch information once the order and payment details have been verified and we have started processing your order. This indicates acceptance of your order, and hence a contract between us.
If we are unable to supply a particular product or unable to verfiy your payment details, we will email you to let you know.

The completion of the contract between you and us will take place on the dispatch of the products ordered.

The Personal Information which you are required to provide when you register as a customer must be accurate, current and complete in all respects and you will notify us immediately of any changes to the Personal Information by contacting our Customer Services department by e-mail. You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.

Delivery Schedule
If your item is in stock (and doesn't need personalisation), we aim to dispatch within 24 hours.

We mainly use Royal Mail 1st class post or 1st Class Recorded Post. Your item should be with you or your recipient within 2-3 working days. Please note if an order is placed outside of business hours the order will be processed the next working day and the guide of 2-3 working days should be taken from the day the goods are despatched.

We also offer a Guaranteed Next Working Day Service for urgent orders (conditions apply)

We aim to dispatch orders as quickly as possible but once orders have left us, they are processed by Royal Mail. Delivery times may vary particularly during peak periods & excludes weekends and bank holidays. We cannot be held responsible for delays caused by Royal Mail, Strike action or other events outside of our control.

Please note that if an item goes missing whilst being processed by Royal Mail, we reserve the right to ask you to wait 15 days before we re-dispatch the item. This is beacuse we cannot claim the parcel as missing with Royal Mail until 15 days after it has been sent. We advise that you check for the parcel at your local depot and neighbours, as sometimes deliveries maybe held there without notification. If after 15 days there is still no sign of your order, we will be more than happy to re-send your order.

If an incorrect or undeliverable delivery address has been supplied then neither Royal Mail or Gifted in Design can be held responsible for delayed or lost orders.

Returns Policy
We want you to be delighted with our items & service, however, if you would like to return an item*, please email us to let us know & return it undamaged within 14 days and we will refund or exchange.

Please be aware when returning goods, the parcel is your responsibility until it reaches us. We suggest that unsuitable items are repacked in original packaging.
It is vital to obtain a "Certificate of Posting" from the Post Office. This is proof of your return should the item go astray in the post.
You are also responsible for the costs of returning items. Shipping charges are not refundable.

If we have sent out an item that is faulty, we shall replace it or refund at your request. We will also reimburse the cost of the return postage. Your high street consumer rights apply online.

* Please note we are unable to refund any item that has been commissioned or personalised for a customer unless the item is faulty.

Cancelling Personalised Items:

If you wish to cancel an order for personalised products, you must inform us immediately to enable us to stop the personalisation process. Once the personalisation process has started, you will be liable to pay in full for any part of your order which has been personalised prior to your cancellation, and any reasonable administrative or delivery costs incurred by us as a result of your cancellation.

Limitation of liability:

While we will use reasonable endeavours to verify the accuracy of any information on the website, we make no warranties in relation to its accuracy. This does not affect your statutory rights as a consumer, nor does it affect your Refund Rights.

We reserve the right to modify or withdraw, temporarily or permanently, this website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the website.

We reserve the right to change the Conditions from time to time, and your continued use of the website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the website.

Credit Card Security
In order to provide complete security, we use Protx and Paypal who are accredited payment service providers to deal with our customers' credit card details.

We do not have access to or keep any of your payment details on our computers & we have had no incidents when fraud has taken place whilst using our site.

Privacy Policy
Gifted in Design never disclose buyers' information to any company for mailing or marketing purposes. We may share your name and address with the artists we work with for dispatch purposes. We require that the artists treat your personal information as fully confidential and to fully comply with all applicable UK Data Protection and consumer legislation. We are committed to protecting your privacy. The information that we collect about you will be used lawfully (in accordance with the Data Protection Act 1998).

We collect information about you for 2 reasons: firstly, to process your order and secondly, to provide you with the best possible service. We will not e-mail you in the future unless you have given us your consent & we will give you the chance to refuse any marketing email from us in the future.

The type of information we will collect about you includes your name, address, phone number and email address. If you would like to pay by Credit or Debit card then you are transferred securely to Protx or Paypal who will take your details. We will never collect sensitive information about you without your explicit consent.

Cookies are used on this site to keep track of the contents of your shopping basket, to store delivery addresses (if the Address Book is used) and to store your details if you select the 'Remember Me' Option. If cookies are turned off, you will be unable to place orders or benefit from the other features that use cookies.

The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly.

The personal information which we hold will be held securely in accordance with our internal security policy and the law. If you have any concerns or questions about security, please email us.

You should be aware that if we are requested by the police or any other regulatory or government authority investigating suspected illegal activities to provide your personal information, we are entitled to do so.

If you have purchased item/s from our partner artists:
Gifted in Design acts as an agent on behalf of the artist. An invoice from the artist is available upon request.
